TERMS & CONDITIONS:

TO THE AGREEMENT - "Facility" means Fit express. "Member" means the person that has agreed to this contract.
• The minimum age for membership at Fit Express 24/7 health club is 16 years of age.
• In consideration of making Fit express available to me: • I have no physical medical condition that would put me or others at risk by using the Facility, • I assume full responsibility for any injuries or damages which may occur to me, • I assume full responsibility for any loss of or damage to my personal property, • I understand that membership cancelation and a penalty fee ($250) will apply if I let in any individual(s) or groups into the location. • I agree to use the equipment in the facility without any supervision or instruction at my own risk,• I recognise and accept that I will be video recorded whilst in the Facility for my own safety, • I will replace and wipe down equipment after I have finished using it, • I will wear comfortable sport clothing and not Jeans, work wear, thongs or other inappropriate attire in the gym,• I Will carry a mobile phone at all times while using the facility outside of staffed hours for my own safety • I recognize and accept that I may have my memberships terminated if I break any facility rules. I agree to the Fit Express Terms and Conditions and affirm that all the information supplied is true and correct.
COVID 19 - SHORT TERM GOVERNMENT MANDATED LOCKDOWN CONDITIONS.
In light of the current economic landscape regarding COVID 19 and mandated government lockdowns, the following terms of service will now be applicable to our direct debit memberships.
At the discretion of FIT EXPRESS, Membership fees for periods of short term Government mandated lockdowns ( Less than a ONE month period ) may not be credited back to the customer. For lockdown periods lasting more than ONE MONTH, membership direct debit charges will stop for any extended period over one month.
Membership fee charges to our customers cover more than just direct usage of the gym. Fees paid on a monthly membership basis by our customers are already at a discounted rate and are used to cover costs in order to maintain the facility and ensure facility usage and services are available for customers when they do attend the gym. Implementing this change to our membership terms is undertaken in order to maintain our low membership fees and continue facility services throughout this current period until mandated lockdowns cease.
SPECIAL REQUIREMENTS & COMMENTS:
SECURITY - Prohibit transferring ID Keycards or permitting entry to non-members. Prohibited to bring additional people in who are not members. Terms - prohibited to provide entry for persons who are not members. Breaches may result in fines of $250 and immediate membership cancellations.
CCTV - video surveillance is in operation 24 hours per day 7 days per week.
For courtesy to other members we request that all members replace weights and equipment after use. The management reserves the right to enforce policy: Breaches may result in possible membership cancellation. Any breach of club rules may result membership cancellation.
GENERAL - Membership to Fit express is for individuals only and its benefits cannot be shared with other individuals or groups. A Member must be 18 years or older (or have the consent of a parent or guardian), in good health and have the approval of their doctor to exercise unsupervised. Members must freely warrant to Fit express that they do not have any physical/medical condition that may affect their ability to exercise safely and without aggravating injury. Fit express reserves the right to grant, refuse or revoke membership rights at its absolute discretion.
FEES AND CHARGES - There is only one type of membership available (unless otherwise stated for special promotions) : 1) “Monthly” membership, where the Member is billed on a per month basis. The Monthly billing cycle starts on the 1st day of each month. The agreed Monthly payment will be applied to the allocated credit card on the 1st day of every month. On the day of the application for the membership the payment for that month will be pro-rated to the end of the month to bring it up to the next month’s payment cycle. The “Monthly” membership is not subject to a minimum term, however if the choice is made to terminate the membership, the Member must complete a cancellation form in person in the Fit express branch they originally signed to. At this time a 30 day notice period will be applied, and the $75 administration fee will be charged. Once a membership is cancelled the membership key card will be de-activated and it cannot be re-used with a new membership application. No refunds or transfers are available under any circumstance. Re-issuing of membership key cards will incur a $30 keycard and administration fee, unless otherwise stated, taken by Fit Express.
NON PAYMENT - A late payment administration fee of up to $20 is payable by the Member for each reversal of a payment initiated in accordance with the terms and conditions of this contract. The administration payment has already been agreed to by a Member in the circumstance of arrears arising. Members that fall into arrears will have their key card access cancelled and will be refused entry until such time that all arrears including the administration fee has been paid. regard to any obligation under this Contract. Should this occur, the full outstanding balance shall be immediately due.
AMENDMENTS - Management reserves the right to amend terms and conditions, hours of operation, location, equipment, facilities and services available in accordance with the changing requirements. Such an amendment can result in a change to membership fees.
CLOTHING - Comfortable sports clothing is required whilst exercising. Fully enclosed sneaker-type shoes and a sweat towel are compulsory. Jeans, work wear, thongs or any other inappropriate apparel are not permitted to be worn while exercising at the Facility. Members are not permitted to remove their tops while exercising in the facility
Adding Collection Costs for unpaid or overdue accounts:
In the event where your overdue account is referred to a collection agency and/or law firm, you will be liable for all costs which would be incurred as if the debt is collected in full, including legal demand costs.
Adding Interest:
Overdue accounts will be subject to interest at the rate of 13% p.a., calculated for the period the account is due until the date it is paid.
